Terms of Service

These Terms constitute a legally binding agreement between you ("Clinic Owner" or "User") and Chikitshalaya Technologies Pvt. Ltd. ("Chikitshalaya", "we", "us"). By creating an account, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement.

Chikitshalaya provides a SaaS platform that enables clinics to:

• Create and manage a professional clinic website
• Accept online appointment bookings from patients
• Manage doctor profiles, patient records, and appointments
• Send automated reminders via SMS and WhatsApp
• Access analytics and reporting dashboards

We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at support@chikitshalaya.com if you suspect unauthorised access.
• One account per clinic. Multiple clinics require separate accounts.

• Plans: We offer Starter (₹999/month), Professional (₹2,499/month), and Premium (₹4,999/month) plans.
• Free Trial: All plans include a 14-day free trial. No credit card required to start.
• Billing Cycle: Subscriptions are billed monthly or annually, in advance.
• Upgrades/Downgrades: You can change your plan at any time. Changes take effect at the start of the next billing cycle.
• Cancellation: You can cancel at any time. Your access continues until the end of the paid period. No refunds for partial months.
• Late Payments: Accounts with failed payments will be suspended after 7 days. Data is preserved for 30 days.

You agree not to:

• Use the platform for any illegal purpose or in violation of applicable laws
• Upload false, misleading, or fraudulent clinic or doctor information
• Harass, threaten, or harm patients or other users
• Attempt to gain unauthorised access to other accounts or our infrastructure
• Scrape, crawl, or extract data from the platform without permission
• Resell or sublicense access to the platform
• Use the platform to send unsolicited communications (spam)

Violation of these terms may result in immediate account termination.

You are the data controller for patient information collected through your clinic's booking page. Chikitshalaya acts as a data processor on your behalf. You are responsible for:

• Obtaining appropriate consent from patients to collect and process their data
• Complying with applicable data protection laws (including India's DPDP Act)
• Ensuring the accuracy of medical and clinical information on your profile
• The quality of healthcare services provided to patients

Chikitshalaya is a technology platform and does not provide medical advice or services. We are not liable for any clinical decisions made by doctors using our platform.

• Chikitshalaya owns all intellectual property in the platform, including software, design, and content.
• You retain ownership of all clinic data, patient records, and content you upload.
• You grant Chikitshalaya a limited license to use your clinic name and logo for marketing (e.g., case studies) with your prior written consent.

To the maximum extent permitted by law, Chikitshalaya shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

We are not liable for service interruptions caused by third parties, force majeure events, or your failure to follow our usage guidelines.

You agree to indemnify and hold harmless Chikitshalaya, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

• You may terminate your account at any time from the dashboard.
• We may terminate your account for material breach of these Terms, with 14 days' notice (or immediately for severe violations).
• Upon termination, you have 30 days to export your data before it is permanently deleted.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

We may update these Terms periodically. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
